MANPOWER SERVICES

FDS specializes in a niche defense export service to support manpower requirements for allied governments and militaries utilizing properly authorized U.S. Persons for the provision of Defense Services in collaboration with foreign defense industry partners, or direct with military end-users.

We provide Instructor Pilot training, a wide variety of military hardware maintenance, installation, integration, and maintenance training programs, as well as staff officer support and full spectrum combat operations training and advisory services. The process by which these manpower personnel are authorized is unique in the defense services industry and can provide significant savings to clients and end-user governments. ♦

CONSULTING SERVICES

FDS consulting provides 

comprehensive export compliance training for both U.S. and foreign industry. We can assist clients with all aspects of export compliance from initial program or company wide assessments and audits, USG exporter and broker registration, product classification,  license and agreements drafting, personnel screening, sensitive data handling and marking, record keeping, reporting, to close out procedures. 

For foreign militaries and governments we design and implement programs with procedures and best practices to ensure compliance with Foreign Military Sales and Direct Commercial Sales contracts to avoid inadvertent and costly violations such as unauthorized exports, reexports, retransfers, and unauthorized personnel access to sensitive data and hardware. ♦

REGULATORY NAVIGATION

Navigating the legal and regulatory requirements imposed on exporters by the U.S. government can be
daunting at best and criminally punitive at worst. FDS has expertise
in managing the regulatory export regimes, security requirements, and best practices to ensure compliance with these often misunderstood regulations. We specialize in assisting client programs related to: 

  • Arms Export Control Act (AECA) and its implementing regulations, the International Traffic in Arms Regulations (ITAR) 

  • Export Administration Act (EAA) and its implementing regulations, Export
    Administration Regulations (EAR) 

  • Office of Foreign Asset Controls (OFAC) and Foreign Corrupt Practices Act (FCPA)

  • National Industrial Security Program (NISP), Instituted by the Defense Security Service (DSS)

  • Constitutional Emoluments
    Clause authorizations. 

FDS was born out of a necessity to satisfy a little known and misunderstood USG regulatory requirement related to the provision of defense services by U.S. persons employed by foreign companies or governments. Our compliance professionals, stationed internationally, discovered regularly occurring inadvertent violations of this nature primarily due to a misinterpretation of the defense export regulations. Misinformed U.S. persons bear the brunt of the associated financial penalties, while foreign companies and governments employing those U.S. persons risk debarment from the U.S. defense trade industry. FDS consultants have the expertise to mitigate fines and penalties by assisting clients through the disclosure process and implementing comprehensive compliance programs.
